Is it legal to use gang affiliations or recent gang activity as a reason not to hire someone?

We want to use recent gang activity or gang affiliations as one criteria in deciding whether or not to hire someone. Since we are a public agency, we would be getting the information from our local police gang unit (they have already agreed to provide the information to HR).
